A product being displayed for sale on our website does not constitute a representation that the product may lawfully be purchased, shipped, received, possessed, carried, transported, transferred, or used in every jurisdiction.

The ability to legally purchase or possess a product does not necessarily mean that it may legally be carried, carried concealed, transported in a particular manner, possessed in a particular location, or used in every circumstance.

Bear Fork Trading Post Inc. does not represent that a product may legally be carried or used in a particular jurisdiction merely because we are able to sell or ship it to you.

We may refuse, hold, restrict, or cancel an order for legitimate reasons including suspected fraud, unauthorized payment activity, inventory errors, pricing errors, technical errors, legal restrictions, carrier restrictions, manufacturer distribution restrictions, inability to verify customer information, or other circumstances that prevent us from reasonably completing the transaction.

If we cancel an order after collecting payment, applicable amounts for the canceled merchandise will be returned to the original payment method.

We may also limit quantities purchased by the same customer, account, payment method, billing address, shipping address, household, dealer, reseller, or distributor.

If an order is canceled because of a pricing, inventory, or other Site error after payment has been collected, applicable amounts will be refunded to the original payment method.

Return Abuse

Bear Fork Trading Post Inc. reserves the right, to the extent permitted by applicable law, to refuse, limit, suspend, or terminate voluntary return privileges in cases involving suspected return fraud, abusive return activity, material or repeated violations of our Return and Refund Policy, falsified claims, intentional product damage, or other misuse of the return process.

Any restriction on voluntary return privileges does not limit rights or remedies that a customer may have under applicable law for defective, damaged, misdescribed, or otherwise legally nonconforming merchandise.


SECTION 12 – SHIPPING AND DELIVERY

Shipping and delivery dates are estimates unless we expressly state otherwise.

Delivery delays may occur because of carrier operations, weather, natural disasters, governmental actions, service interruptions, incorrect customer-provided information, or other circumstances beyond our reasonable control.

Customers are responsible for providing a complete, accurate, and deliverable shipping address.

Certain products may be subject to restrictions imposed by applicable law, the United States Postal Service, private carriers, manufacturers, or destination jurisdictions.

Bear Fork Trading Post Inc. may change the shipping carrier or shipping method, request additional information, hold an order for review, or cancel an order that cannot lawfully or reasonably be shipped.

Freight Forwarders and Reshipping Services

If a customer chooses to have an order delivered to a freight forwarder, reshipping company, package consolidation service, export service, or similar third party selected by the customer, confirmed delivery to the address provided by the customer will constitute delivery of the order for purposes of our shipping obligations, except where otherwise required by applicable law.

After confirmed delivery to that third-party service, Bear Fork Trading Post Inc. is not responsible for loss, theft, damage, delay, alteration, misdelivery, customs seizure, confiscation, or other events occurring while the package is in the possession or control of the freight forwarder, reshipper, consolidation service, or subsequent carrier, except to the extent responsibility cannot legally be excluded.

Customers using such services are responsible for ensuring that the forwarding service and ultimate destination comply with applicable law.


SECTION 13 – INTERNATIONAL ORDERS

International customers are responsible for determining whether products may lawfully be exported, imported, cleared through customs, delivered, received, possessed, carried, transported, or used in the destination country or jurisdiction.

Bear Fork Trading Post Inc. cannot guarantee that an item lawful for sale in the United States will be permitted for import into another country.

International packages may be delayed, inspected, rejected, returned, seized, or confiscated by customs or other governmental authorities.

Customers are responsible for applicable customs duties, import taxes, brokerage fees, tariffs, governmental assessments, and other import-related charges unless otherwise expressly stated at checkout.

As provided in our Return and Refund Policy, international orders are final sale and are not eligible for voluntary returns or exchanges, except where otherwise required by applicable law.

Nothing in this section limits rights or remedies that applicable law does not permit to be waived.


SECTION 14 – MANUFACTURER WARRANTIES

Certain products may include warranties offered by the manufacturer.

Manufacturer warranties are governed by the applicable manufacturer’s terms and conditions.

Unless expressly stated otherwise, a manufacturer warranty does not expand Bear Fork Trading Post Inc.’s own Return and Refund Policy.

Aggregate Liability

To the maximum extent permitted by applicable law, and except for liabilities that cannot lawfully be excluded or limited, the aggregate liability of Bear Fork Trading Post Inc. arising out of or relating to a particular transaction, product, or order will not exceed the amount actually paid to Bear Fork Trading Post Inc. for the product or products giving rise to the claim.

SECTION 23 – INDEMNIFICATION

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Bear Fork Trading Post Inc., its officers, directors, employees, agents, and affiliates from third-party claims, losses, liabilities, damages, and reasonable costs arising from:

  • Your transfer of a product to a person whom you know is legally prohibited from receiving or possessing it; or

This provision does not apply to the extent a claim results from conduct or liability of Bear Fork Trading Post Inc. that applicable law does not permit to be waived, disclaimed, transferred, or indemnified.
